1. General Information

These Terms of Service apply to purchases made through the Ora et Forma online store operated by Laura Sachs.

2. Scope and Contract

These Terms of Service apply to all orders placed through the Ora et Forma online store.

By placing an order, you submit a binding offer to purchase the selected products.

The contract is concluded when your order is accepted by Ora et Forma, including through confirmation of the order by email or by another clear confirmation of acceptance.

The products and prices displayed in the online store at the time of purchase apply.

3. Products

Ora et Forma offers physical printed products, including print-on-demand products, as well as digital products such as digital art downloads.

Product images are intended to provide an accurate representation of the products. Due to differences in screens, lighting, materials, printing processes, and individual device settings, minor variations in colors or appearance may occur.

Physical products may be produced specifically after an order has been placed. Production by a print-on-demand provider does not, by itself, exclude any statutory consumer rights.

4. Prices and Taxes

All prices are stated in euros (EUR) and include applicable taxes unless otherwise stated.

If the Kleinunternehmerregelung pursuant to § 19 UStG applies to the seller, no German VAT is charged separately.

Shipping costs, where applicable, are displayed separately before the order is placed.

5. Payment

Available payment methods are displayed during checkout.

Payment must be completed using one of the payment methods offered through the online store.

An order may not be fulfilled until the required payment has been successfully processed.

6. Production and Fulfillment

Physical products are produced and fulfilled through third-party print-on-demand and fulfillment providers.

After an order is placed, the product may enter production automatically.

Production and delivery times may vary depending on the product, destination, fulfillment location, and shipping provider.

Ora et Forma is not responsible for delays caused by circumstances outside its reasonable control, including carrier delays, customs procedures, strikes, severe weather, or other events beyond reasonable control.

This does not affect statutory consumer rights.

7. Shipping and Delivery

Shipping is available to the destinations offered at checkout.

Available shipping options, estimated delivery times, and shipping costs are displayed during the purchasing process where applicable.

Delivery times are estimates and may vary depending on destination and fulfillment conditions.

Customers are responsible for providing a correct and complete delivery address.

If an order cannot be delivered because an incorrect or incomplete address was provided by the customer, additional shipping costs may apply where legally permissible.

For international orders, customs duties, import taxes, or other charges imposed by the destination country may apply where applicable. Such charges are not controlled by Ora et Forma.

8. Digital Products and Downloads

Digital products are provided electronically.

Depending on the product, digital files may be delivered through a download link, PDF instruction file, or another electronic delivery method specified on the product page or after purchase.

Digital files are intended for the personal use of the purchaser unless otherwise stated.

Digital products may not be resold, redistributed, publicly shared, uploaded to file-sharing services, or otherwise commercially exploited without written permission.

If a digital download cannot be accessed because of a technical problem with the delivery system, please contact oraetforma@gmail.com so that the issue can be investigated and, where appropriate, the files can be provided again.

9. Right of Withdrawal

Consumers generally have a statutory 14-day right of withdrawal for distance contracts, subject to the statutory exceptions.

For physical products, the withdrawal period generally begins when the consumer, or a third party designated by the consumer, receives the goods.

The exercise of the right of withdrawal does not require a reason.

The statutory withdrawal rules, including the applicable exceptions, apply regardless of whether a physical product was produced through a print-on-demand process.

Digital Downloads

For digital content that is supplied electronically and not on a physical data carrier, the statutory right of withdrawal may expire once the supply of the digital content begins if the consumer has expressly agreed before supply begins that performance should begin before the end of the withdrawal period and has confirmed their knowledge that this causes the loss of the right of withdrawal, as required by applicable German law.

The relevant consent and acknowledgement will be obtained through the applicable checkout or digital-delivery process where required.

10. Returns and Refunds

Where a consumer validly exercises their statutory right of withdrawal, the applicable statutory rules concerning refunds and return shipping costs apply.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise agreed with the consumer.

For physical products, Ora et Forma may withhold the refund until the goods have been returned or the consumer has provided evidence that the goods have been sent back, whichever occurs first, where permitted by law.

The consumer is responsible for the direct cost of returning goods where the statutory requirements for doing so are met and Ora et Forma has informed the consumer accordingly.

Statutory warranty and consumer rights concerning defective or non-conforming products remain unaffected.

11. Defective or Incorrect Products

If a product arrives damaged, defective, or materially different from what was ordered, please contact:

Please provide your order number and, where relevant, photographs showing the issue.

Ora et Forma will review the issue and provide the appropriate remedy in accordance with applicable consumer law.

12. Intellectual Property

All original artwork, designs, photographs, graphics, text, branding, and other content created for Ora et Forma are protected by applicable intellectual-property laws.

Unless expressly permitted in writing, customers may not reproduce, distribute, modify, resell, publicly display, commercially exploit, or otherwise use Ora et Forma artwork or digital files beyond the rights granted with the purchased product.

Purchasing a physical product or digital download does not transfer ownership of the underlying intellectual-property rights.

13. Personal Use of Digital Artwork

Unless a product description expressly states otherwise, digital downloads are licensed for personal, non-commercial use only.

The purchaser may print the purchased artwork for personal use.

The purchaser may not:

resell the digital files;
redistribute or share the files;
upload the files to public or shared download platforms;
use the files to create products for resale;
claim the artwork as their own;
use the artwork commercially without written permission.

14. Availability and Product Changes

Ora et Forma reserves the right to modify, discontinue, or update products, product descriptions, pricing, availability, and collections.

Such changes do not affect orders that have already been accepted unless otherwise required by law.

In the event of an obvious pricing or technical error affecting an order, Ora et Forma reserves the right to correct the error and, where legally permissible, cancel the affected order and refund any payment already made.

15. Liability

Ora et Forma is liable without limitation for damages resulting from intentional or grossly negligent conduct, injury to life, body, or health, and in other cases where liability cannot legally be excluded or limited.

For ordinary negligence, liability is limited to breaches of essential contractual obligations to the extent permitted by applicable law.

Nothing in these Terms of Service limits mandatory statutory consumer rights.

16. Governing Law

German law applies to these Terms of Service.

Where a customer is a consumer whose habitual residence is in another country, mandatory consumer-protection provisions of that country that cannot be excluded by agreement remain unaffected.
